All content on this website (including text, design, layout, code, graphics, logos, project descriptions, and case-study materials) is owned by Erdel or used with permission, and is protected by UK and international copyright law.
You may view and download pages from the site for personal, non-commercial reference. You may not republish, redistribute, or reuse our content elsewhere without our written consent.
"Erdel" and the Erdel logo are trade marks of the studio. Other product and company names referenced on the site are the property of their respective owners.
Where the site shows work created for clients (e.g. Neck Tapers, Jet Cupping, Quizly, etc.), the client owns their brand, content, and customer data; Erdel retains ownership of the underlying source code and build methods. Erdel showcases the projects with permission and may reference them in our portfolio. Specific contractual terms for any client engagement are set out in a separate written agreement.
This clause sets out, in plain English, who owns what in any app, website, or other software Erdel builds for a client. The specifics for any given project are confirmed in the individual project agreement, which prevails over this general statement.
What the client owns: the client retains full ownership of their brand, name, logo, trade marks, written content, product imagery, customer data, customer relationships, and any other materials they supply to us. The domain, DNS, and any developer accounts (e.g. Apple Developer, Google Play Console) registered in the client's name remain the client's property.
What Erdel retains: Erdel owns the underlying source code, software, frameworks, libraries, components, tools, processes, and build methods used to design, develop, and deliver the app or website (collectively, "the blueprint"). This includes any reusable patterns, internal libraries, infrastructure code, and engineering know-how that pre-exist the project or are developed by Erdel in the course of our work.
The client's right to use: on full payment of the agreed fees, Erdel grants the client a perpetual, non-exclusive, non-transferable licence to use the delivered app or website for the client's own business purposes. This licence covers the client's operation of the product as built, but does not transfer ownership of the blueprint itself, and does not include the right to resell, sublicense, or repackage the underlying code as a separate product.
Hosting & maintenance: Erdel typically builds, hosts, and maintains the app or website on the client's behalf under a separate ongoing service arrangement. The client's data remains the client's property at all times and is exportable on request.
Project-specific terms prevail: the precise ownership, licensing, and transfer terms for any project (including any variations to this general clause) are set out in the individual written project agreement between Erdel and the client. In the event of a conflict, the project agreement governs.
The website is provided "as is" and "as available". We make no warranties, express or implied, that the site will be uninterrupted, error-free, secure, or that any information on it is accurate, complete, or up to date.
Project examples, timelines, and pricing references on the site are illustrative, so your project may differ. Nothing on the site constitutes a binding offer; we will always provide a written quote before any work starts.
To the fullest extent permitted by law, Erdel is not liable for any indirect, incidental, special, or consequential loss or damage arising from your use of (or inability to use) this website, including any loss of data, profits, or business.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
The site may contain links to third-party websites (for example, our clients' live sites, social media profiles, or external reference resources). We are not responsible for the content, privacy practices, or availability of any third-party site.
Your use of the site is also governed by our Privacy Policy, which explains what data we collect and how we use it.
We may update these terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continuing to use the site after a change constitutes acceptance of the updated terms.
These Terms & Conditions are governed by the laws of England & Wales. Any disputes arising in connection with the website or these terms will be subject to the exclusive jurisdiction of the courts of England & Wales.
